DNP 810 Topic 8: client rights in genomic decisions

The word rights narrows this: not what could go wrong with genomic medicine, but what specifically undermines a client's capacity to decide for themselves and act on the decision.

01

Rights, not risks — the prompt is about autonomy

Read rights rather than risks, because the two produce different lists. What undermines a client's right to decide is anything that removes informed choice or the ability to act on it. Consent that is not genuinely informed is the first and strongest candidate: a genomic test may return variants of uncertain significance, incidental findings unrelated to the reason for testing, and information about relatives who consented to nothing, and a consent process that does not surface those in advance has not obtained agreement to what actually happens. Privacy and secondary use is a second: results flow into records, research databases, and in the direct-to-consumer market into commercial datasets whose terms of service most people have never read, and re-identification from genomic data is not a theoretical concern. Each of these removes something the client would need in order to decide freely, which is what makes it a rights issue rather than a hazard of the technology.

Other strong candidates are access and discrimination. Access undermines rights when testing, counselling or the therapy a result unlocks is available only to those who can pay or who live near a centre — a right to choose is empty if only one option is reachable. Discrimination undermines rights in the markets GINA does not reach, since a client weighing a clinically indicated test against the risk to their life insurance is not making a free clinical decision. For each issue give a solution at the right level, whether that is a structured consent process covering incidental findings, a data governance rule, or a policy change. Then answer the advocate question in the first person and locally: what you would do in your own practice, which usually means slowing a consent conversation down, checking understanding rather than signature, and knowing where to refer when a client needs counselling you cannot provide.

Likely learning objectives

Inferred from the brief — check these against your own rubric.

  • 01
Distinguish threats to client rights from risks of genomic medicine generally.
  • 02
Explain why genomic consent differs from consent to an ordinary test.
  • 03
Propose solutions at the level the problem sits.
  • 04
State a first-person advocacy role that is actually within your control.

This is a -week course and requires a lot of time commitment, organization, and a high level of dedication. Please use the class syllabus to guide you through all the assignments required for the course. I have also attached the classroom policies to this announcement to know your expectations for this course. Please review this document carefully and ask me any questions if you do. You could email me at any time or send me a message via the “message” icon in halo if you need to contact me. I check my email regularly, so you should get a response within 24 hours. If you have not heard from me within 24 hours and need to contact me urgently, please send a follow up text to. I strongly encourage that you do not wait until the very last minute to complete your assignments. Your assignments in weeks 4 and 5 require early planning as you would need to present a teaching plan and interview a community health provider. I advise you look at the requirements for these assignments at the beginning of the course and plan accordingly. I have posted the YouTube link that explains all the class assignments in detail. It is required that you watch this 32-minute video as the assignments from week 3 through 5 require that you follow the instructions to the letter to succeed. Failure to complete these assignments according to instructions might lead to a zero. After watching the video, please schedule a one-on-one with me to discuss your topic for your project by the second week of class. Use this link to schedule a 15-minute session. Please, call me at the time of your appointment on my number. Please note that I will NOT call you. Please, be advised I do NOT accept any assignments by email. If you are having technical issues with uploading an assignment, contact the technical department and inform me of the issue. If you have any issues that would prevent you from getting your assignments to me by the deadline, please inform me to request a possible extension. Note that working fulltime or overtime is no excuse for late assignments. There is a 5%-point deduction for every day your assignment is late. This only applies to approved extensions. Late assignments will not be accepted. If you think you would be needing accommodations due to any reasons, please contact the appropriate department to request accommodations. Plagiarism is highly prohibited. Please ensure you are citing your sources correctly using APA 7th edition. All assignments including discussion posts should be formatted in APA with the appropriate spacing, font, margin, and indents. Any papers not well formatted would be returned back to you, hence, I advise you review APA formatting style. I have attached a sample paper in APA format and will also post sample discussion responses in subsequent announcements. Your initial discussion post should be a minimum of 200 words and response posts should be a minimum of 150 words. Be advised that I grade based on quality and not necessarily the number of words you post. A minimum of TWO references should be used for your initial post. For your response post, you do not need references as personal experiences would count as response posts. If you however cite anything from the literature for your response post, it is required that you cite your reference. You should include a minimum of THREE references for papers in this course. Please note that references should be no more than 5 years old except recommended as a resource for the class. Furthermore, for each discussion board question, you need ONE initial substantive response and TWO substantive responses to either your classmates or your instructor for a total of THREE responses. There are TWO discussion questions each week, hence, you need a total minimum of SIX discussion posts for each week. I usually post a discussion question each week. You could also respond to these as it would count towards your required SIX discussion posts for the week. I understand this is a lot of information to cover in 5 weeks, however, the Bible says in Philippians 4:13 that we can do all things through Christ that strengthens us. Even in times like this, we are encouraged by God’s word that we have that ability in us to succeed with His strength. I pray that each and every one of you receives strength for this course and life generally as we navigate through this pandemic that is shaking our world today. Relax and enjoy the course!

Turn the brief into deliverables

  1. 01
Two issues that specifically undermine client rights.
  2. 02
A potential solution for each, at an appropriate level.
  3. 03
Your own role as patient advocate, stated concretely.
  4. 04
    Support from credible sources.
03

Two issues, two solutions, then your own role

01

The first issue

Set out what it is and how it removes informed choice.

02

Its solution

Propose a remedy at the level the problem occurs.

03

The second issue and its solution

Repeat for a distinct issue rather than a variation on the first.

04

Your role as advocate

State what you would do in your own practice, in the first person.

04

Where the protections are written down

Recommended databases

  • National Human Genome Research Institute
  • MedlinePlus Genetics
  • ANA Code of Ethics
  • PubMed Central

Search sequence

  1. 1.
Read what a genomic consent process is expected to cover before writing about consent.
  2. 2.
Check what GINA does and does not protect, since that decides whether discrimination is an issue.
  3. 3.
Search variants of uncertain significance for the disclosure problem in its own terms.
  4. 4.
Look at the ANA provisions on advocacy for the language of the final section.

  1. 01

What is genetic testing?: MedlinePlus Genetics

MedlinePlus, U.S. National Library of Medicine · 2024

What a genetic test result actually establishes, which is what a genuine consent process has to convey.

  2. 02

    Genetic Discrimination

National Human Genome Research Institute · 2024

Where discrimination protections stop, which is the concrete basis for the rights argument.

  3. 03

2025 Code of Ethics for Nurses

    American Nurses Association · 2025

The professional basis of the advocacy role the final section has to describe.

  4. 04

Genetic Information Nondiscrimination Act of 2008 | U.S. Equal Employment Opportunity Commission

    U.S. Equal Employment Opportunity Commission · 2008

The statute itself, so the discrimination issue rests on what the law says rather than on impression.

06

Review before submission

Common mistakes

  • Listing risks of genomic medicine rather than threats to rights.
  • Treating consent as a signature rather than as a process.
  • Proposing a national policy as your personal advocacy role.
  • Ignoring that a genomic result implicates relatives who did not consent.
  • Missing access as a rights issue rather than a resource issue.

Submission checklist

  • Does each issue actually reduce a client's ability to choose or act?
  • Is there a solution attached to each?
  • Is your advocacy role something you personally could do?
  • Have you addressed the implications for relatives?
  • Are the sources credible and current?
